Acceptance of Terms
By creating an account or using MenuSparks, you agree to these Terms of Service. If you do not agree, please do not use the service. We may update these terms from time to time, and continued use after changes are posted means you accept the new terms.
Service Description
MenuSparks is a recipe generation and menu optimization platform designed for restaurants. You provide ingredients, preferences, and restaurant details, and the platform generates chef-level recipes with portions, food cost estimates, and social media content. The service is provided as a software tool to assist your menu planning — it does not replace professional culinary judgment.
Account Responsibilities
- You must provide accurate information when creating your account.
- You are responsible for maintaining the security of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must be at least 18 years old to use MenuSparks.
- One account per person or business entity. Shared logins across multiple locations require separate subscriptions.
Acceptable Use
You agree not to:
- Use the service for any unlawful purpose.
- Attempt to reverse-engineer, scrape, or extract the underlying recipe generation system.
- Resell, redistribute, or sublicense access to MenuSparks or its outputs in bulk.
- Use automated tools (bots, scripts) to access the service beyond normal usage.
- Interfere with or disrupt the service or its infrastructure.
Subscription and Billing
- MenuSparks offers a free tier (5 recipes) and a paid monthly subscription.
- Paid subscriptions are billed monthly through Stripe.
- You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period.
- We do not offer partial refunds for unused portions of a billing period.
- We reserve the right to change pricing with 30 days' notice. Existing subscribers on founding pricing will retain their locked-in rate as long as their subscription remains active and in good standing. If you cancel and later resubscribe, the current pricing at the time of resubscription will apply.
Intellectual Property
Your content: The recipes generated through MenuSparks are yours to use commercially in your restaurant, on your menus, in marketing materials, and for any other legitimate business purpose. You own the rights to use, modify, and publish any recipe output generated for your account.
Our platform: The MenuSparks name, logo, website design, and underlying technology remain the intellectual property of MenuSparks. You may not copy, modify, or distribute the platform itself.
Generated Content Disclaimer
MenuSparks uses automated recipe generation technology to create recipes, menu suggestions, and related content. All generated output is intended as a starting point and professional aid — not a substitute for culinary expertise or professional judgment.
- Generated recipes may contain errors in quantities, techniques, or ingredient combinations. Always review recipes with qualified kitchen staff before service.
- Food cost estimates are approximations and must be verified against your actual supplier invoices.
- Social media content generated by the platform should be reviewed before posting to ensure it accurately represents your restaurant and menu.
- MenuSparks does not guarantee that any generated recipe will produce a specific flavor, texture, or result.
Allergen and Food Safety Liability
This is critical. MenuSparks does not guarantee allergen-free recipes. Generated recipes may contain or suggest ingredients that are common allergens (nuts, dairy, gluten, shellfish, soy, eggs, etc.) even when filters are applied.
- You are solely responsible for verifying that all recipes served at your establishment comply with local health codes, allergen labeling requirements, and food safety regulations.
- MenuSparks does not replace allergen management protocols, HACCP plans, or food safety training.
- Always cross-check generated ingredients against your customers' known allergies and dietary restrictions before preparation and service.
- MenuSparks shall not be held liable for any allergic reactions, food safety incidents, or health issues arising from the preparation or service of recipes generated by the platform.
Limitation of Liability
MenuSparks is a menu planning and recipe generation tool. While we strive to provide accurate portion sizes, food cost estimates, and preparation instructions:
- Food safety is your responsibility. All recipes should be reviewed by qualified kitchen staff before service. MenuSparks does not guarantee that generated recipes meet all food safety, allergen, or regulatory requirements for your jurisdiction.
- Food cost estimates are approximations based on general market data and should be verified against your actual supplier pricing.
- MenuSparks is provided “as is” without warranties of any kind, express or implied.
- To the maximum extent permitted by law, MenuSparks shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
- Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim.
Termination
We reserve the right to suspend or terminate your account if you violate these terms or engage in conduct that we reasonably believe is harmful to the service or other users. You may delete your account at any time by contacting us.
Modifications to the Service
We may modify, update, or discontinue features of MenuSparks at any time. We will make reasonable efforts to notify users of significant changes. Continued use of the service after modifications constitutes acceptance of those changes.
Governing Law
These terms are governed by and construed in accordance with the laws of the State of New Hampshire, United States. Any disputes arising from these terms or your use of MenuSparks shall be resolved in the courts located in Hillsborough County, New Hampshire.
